The effect of alcohol on an individual is determined primarily by two factors: the amount of alcohol consumed and the rate at which it is absorbed by the body. Other contributing factors include gender, body weight, alcohol tolerance, mood, environment and the amount of food consumed. 

From the first drink, alcohol affects coordination and judgment. Even with a BAC well below .08 percent, a person's reaction time slows. The risk of being in a crash begins to increase between a BAC of .04 and .05 percent and increases rapidly thereafter.  By the time a driver reaches a BAC of .06 percent, he/she is twice as likely to be involved in a fatal crash as

a non-drinking driver. By the time a driver reaches a BAC of .08 percent, he/she is 11 times more likely to be killed in a single-vehicle crash than a non-drinking driver. 

The only way to rid the body of alcohol is time. Fresh air, coffee, showers and food cannot help a person sober up. It takes about one hour for the body to metabolize one drink. Each of the following has a comparable amount of alcohol and counts as one drink: one 12-ounce mug of beer, one 5-ounce glass of wine or a one 1.5-ounce shot of hard liquor.

DRIVER'S LICENSE: (30 Day Letter)

 

When you are charged with DUI, you have ten (30) days to send a certified letter to the Department of Driver Services in order to preserve your privilege to drive.  If you fail to send this 30-day letter, you driver's license is automatically suspended after 45 days from the date of your DUI arrest.  At the Law Office of David S. Lee, LLC, we will not charge you any attorney fee for sending this letter.  However, recent changes in the law have added a state fee of $150.00 for every letter sent to the Department of Driver Services (DDS).

 

 

DUI PENALTIES:

 

First Lifetime DUI:

 

  • 10 days in jail, can suspend or probate all but 24 hours

  • 40 hours of community service

  • Fine of $300 - $1000

  • License suspension for 12 months - maybe eligible for temporary license

  • Alcohol evaluation and treatment if necessary

  • Rick Reduction (DUI school)

  • 12 months on probation

 

 

Second DUI In 10 Years:

 

  • 90 days in jail, can suspend or probate all but 72 hours

  • 30 days of community service (240 hours)

  • Fine of $600 - $1000

  • License suspension for 3 years - maybe eligible for temporary license after 12 months

  • Alcohol treatment

  • Rick Reduction (DUI school)

  • 12 months on probation - could be longer

  • Photograph published in paper

  • Ignition interlock device on car

 

 

Third DUI In 10 Years:

 

  • 120 days in jail, can suspend or probate all but 15 days

  • Not less than 30 days of community service - could be more

  • Fine of $1000 - $5000

  • License suspension for 5 years - maybe eligible for temporary license after 2 years

  • Alcohol treatment

  • Rick Reduction (DUI school)

  • 12 month on probation

  • Photograph published in paper

  • Ignition interlock device on car after 2 years
